DISTANCE SALES AGREEMENT

ARTICLE 1: PARTIES


On one side, PİR TURİSTİK TESİSLER İNŞAAT İŞLETME SANAYİ VE TİCARET A.Ş. with the address Kocatepe Mah. Şehit Muhtar Bey Cad. Cem Alı Apt No:22 İç Kapı No:4 Beyoğlu/Istanbul (hereinafter referred to as "SELLER" in this agreement) and on the other side, the consumer(s) whose details are provided below, an Accommodation Sales Agreement has been made within the framework of the following terms regarding reservation and accommodation services.


ARTICLE 2: SUBJECT


The subject of this agreement covers the mutual rights and obligations of the parties regarding the hotel accommodation sales service and accommodation sales service for tourism purpose residences, which the Seller sells to the Consumer via the heritagehomestr.com website, as described below with the specifications, sales price, and terms, in accordance with the provisions of the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.


"ARTICLE 3: CONTRACT PRICE and PAYMENT TERMS "


3.1. The Consumer will pay the Contract price via credit card via the Seller's website or via EFT/money transfer to the bank accounts specified by the Seller.

3.2. All services included in the price are detailed on the accommodation website and in the Reservation Document. Services beyond these are subject to an additional charge. Specifically, the purchased service does not include the cost of any additional food and beverages, personal expenses, transportation, or any other goods and services not included in the accommodation.

3.3. The consumer is obligated to pay at least 50% of the contract price as a prepayment at the time of registration, and the remaining balance no later than 15 days before the service begins; at the time of reservation for hotel or tourist accommodations with a check-in date of 7 days or less; and on the date of reservation for early reservations, promotional offers, and special product accommodation sales. If payments are not made within the specified timeframe, the reservation will be canceled, and 50% of the service fee will be billed to the consumer as cancellation compensation. Furthermore, the prepayment is considered a security deposit and is non-refundable.

3.4. In credit card payments, the Consumer accepts and undertakes to pay the interest, maturity difference and exchange rate difference, which will be calculated and notified by the Seller, in addition to the contract price.


ARTICLE 4: CANCELLATION, TRANSFER and CHANGES


4.1. For cancellations and changes to reservations, you must contact the Support line 0252 712 01 28 or send a written statement of the valid reason to info@heritagehomestr.com.

4.2. The following rules apply for cancellations and changes:

a. If the consumer requests a cancellation or change up to 15 days prior to the facility check-in date, the full amount will be refunded. For cancellations or changes made up to 14 days prior to the facility check-in date for reasons other than the death or serious illness of the consumer or their immediate family member, the consumer is responsible for 50% of the total price. For cancellations or changes made less than 7 days prior to the facility check-in date, the consumer is responsible for the full amount, and agrees and undertakes to pay these costs to the Seller.

b. If the Consumer wishes to cancel or change the discounted product purchased during the early booking period for any reason, he/she accepts and undertakes to pay 50% of the total price to the Seller up to 7 days before check-in at the facility, and the entire accommodation fee less than 7 days before check-in.

c. If the consumer wishes to change the date of the discounted early booking product purchased during the discounted sales period for any reason, he/she accepts that the reservation change will be made without a discount, based on the list prices valid on the date of the request.

d. Unless the consumer states in writing any changes he/she wishes regarding the reservation for which he/she has made the prepayment, at least 7 days before check-in at the facility, the accommodation terms and conditions stated in this contract and the reservation will be valid.

e. If the consumer fails to notify in writing that they will not be able to go to/reach the accommodation, the Seller has the right to cancel all reservations made for the consumer within 24 hours of the accommodation start date. No refund will be made to the consumer in such cancellations. The parties agree to this in advance.

f. The Seller must fulfill its obligations within the agreed period, commencing from the date the consumer receives the reservation. If the Seller fails to fulfill its obligations, the consumer may terminate the contract. In the event of termination, the Seller must refund all payments received to the consumer within fourteen (14) days from the date the termination notice is received.

g. In cases where it becomes impossible to fulfill the service provided for the reservation, the Seller is obliged to notify the consumer within three days from the date of learning about this situation and to refund all collected payments within fourteen days from the date of notification.

h. If the seller terminates the contract unfairly, he must refund all payments made by the consumer up to that date.

4.3. Requests for changes other than the date specified in the consumer's reservation will be considered, provided that they are notified to the Seller no later than seven days before the service start date. The Seller will handle these change requests to the extent possible; no objection can be made to the Seller, and the Seller cannot be held responsible for any change requests that cannot be fulfilled.

4.4. In case of early departure from the hotel or tourist accommodation, the consumer accepts and undertakes that he/she is responsible for paying the full contract price and that he/she will pay this amount to the Seller.

4.5. Refunds for payments made will be made to the credit card or bank account used at the time of booking.




ARTICLE 5: OTHER PROVISIONS


5.1. The information regarding the accommodations subject to this agreement has been reviewed and evaluated by the Consumer on the Seller's website. The accommodation price and payment method are visible to the Consumer before completing the reservation on the website, and the Consumer can choose one of the payment options at their discretion. The Consumer completes the payment by entering their credit card information into the system. The system where credit card information is entered is protected by international security software, and it is not possible to view or copy any of the information. However, the Seller is not liable for any penalties or compensation for any losses the Consumer may incur due to viruses, software, or third parties obtaining their passwords and information due to the Consumer's negligence. The Seller has no obligation to pay any penalties or compensation for any losses the Consumer may incur as a result of such transactions. Furthermore, the Seller reserves the right to recourse against the Consumer for any losses that may arise from these causes.

5.2. It is the duty of care of any bona fide consumer to notify the authorized service representative of any complaints they may have during the service. If the consumer uses the service to its fullest extent without notifying the Seller's authorized service representative despite a complaint, this will void any rights to compensation, such as replacement service or a refund, related to the complaint.

5.3. Even if the consumer has not been able to sign this hotel or tourist accommodation reservation contract by mail order, virtual POS, money order or EFT for any reason, he/she has learned the terms of this contract that will be valid between the parties from the catalogue, website or advertisements and has undertaken to receive this hotel or tourist accommodation reservation contract in accordance with the written conditions in this contract.

5.4. The Consumer undertakes to read and sign this contract after obtaining all kinds of information about the hotel or tourist residence mentioned in the contract signed with this hotel or tourist residence reservation from the Seller's web addresses and after making all necessary examination.

5.5. If you do not check into the hotel or tourist residence without cancellation, the accommodation fee will not be refunded. In cases of death, illness, or accident, and if force majeure is documented, the fee for the missed stay will be refunded. If you check in late or check out early for any reason other than these, the fee for the remaining stay will not be refunded.

5.6. ID and age checks are conducted upon entry to the facility. Any discrepancies arising from incorrect or incomplete declarations will be collected upon check-in at the hotel or tourist residence.

5.7. Accommodation dates, names of the persons staying, the facility-room type where the accommodation will be provided, the accommodation system are clearly stated on the promotional page published on the Seller's website, which is an annex and an integral part of this contract, and in the reservation records made by the consumer.

5.8. The Consumer will stay between the dates specified in the reservation. If the facility is available outside of these dates, the Consumer may extend the stay after requesting and paying for the extension to the Seller.

5.9. The seller is not responsible for any loss and/or damage or theft of valuables at the consumer's accommodation facility.

5.10. Consumers accept, declare and undertake that, regardless of their arrival time at the hotel or residences where they will be accommodated for tourist purposes, settling into their rooms will be possible at 14:00 at the earliest, and that on the day of departure, regardless of their departure time from the facility, the rooms must be vacated at 12:00 at the latest, and that they will be responsible for the costs of any additional food, beverages and non-system services they will receive at the facility.

5.11. Consumers who do not sign the contract but participate in the service covered by the contract are deemed to have accepted and agreed to the terms of this contract upon the person they have designated to register on their behalf reading and signing this contract. The Seller reserves the right to recourse against other consumers for the collection of any excess amount or service fee paid to the contract signatories.

5.12. The consumer accepts and declares that he/she has received, read and is informed about the characteristics, sales price, payment method, performance and all other preliminary information of the product/service subject to the contract and has given the necessary confirmation electronically.

5.13. Invoices are sent to the address specified by the consumer in the invoice address section when making a reservation. If the invoice address section is left blank, the invoice will be sent to the contact information provided. The Seller is not responsible for any undelivered invoices due to an incorrect address, a failure to specify the delivery address, or the failure to locate the delivery person at the specified address.

5.14. Child discounts apply when staying in the same room as their parent. The age of the child declared by the Consumer is taken into account when booking reservations for families with children. However, if a difference is detected between the child's age stated on the child ID requested by the facility staff during check-in at the hotel or tourist residence and the age stated, the Consumer will pay the difference to the Seller, and the necessary changes will be made.

5.15. Adverse weather conditions, road blocks, terrorism, strikes/lockouts, the possibility of war, floods, fires, unforeseen technical issues, etc., are considered force majeure. If such reasons prevent the accommodation from starting or continuing, the Seller may cancel the accommodation or replace it with another accommodation of the same category and quality, either in the same region or elsewhere. In such cases, the consumer has no right to compensation.

5.16. In cases where accommodations are sold with artists, such as holidays, New Year's Eve, etc., and in cases beyond the hotel's control (the artist becomes ill), the Seller reserves the right to change the artist.

5.17. The Hotel or Tourism Accommodation Reservation/Registration document is an annex and an integral part of this contract and is binding for the parties.




ARTICLE 6: COMPETENT COURT


"In the resolution of disputes arising from the implementation of this accommodation agreement; primarily, the provisions of this agreement, the Consumer Protection Law No. 6502, and the relevant Regulation provisions will apply. The parties, within the legal limits, may apply to the Consumer Courts and/or the Consumer Disputes Arbitration Committee. The competent court for resolving disputes is the Istanbul Çağlayan court and enforcement offices. The Consumer acknowledges and declares that they have received a copy of all the information regarding the nature of the service, sale price, payment method, and performance, as written in the promotional page on the website and in the reservation document, in electronic form, have read and understood it, and have given the necessary electronic confirmation."
